AstraZeneca Plc (AZN) and Bristol-Myers Squibb Co. (BMY) won an appeal of an 11-year-old lawsuit in which they were accused of paying kickbacks to a medical benefits-management company in return for purchases and recommendations of drugs they make.
A complaint filed by a former employee of the benefits company doesn’t satisfy the federal False Claims Act’s requirement that a whistle-blower be the original source of allegations of wrongdoing, the federal appeals court in Philadelphia ruled today, affirming last year’s lower-court decision to reject the case.
