Keneric Healthcare Release: U.S. Patent & Trademark Office Rejects Hydrofera Patent

Keneric Healthcare (formerly GWM Products, LLC), manufacturer and distributor of RTD® Wound Dressing, announced today that the key claim in the Hydrofera '764 patent has been rejected for the second time in a Final Office Action by the Patent & Trademark Office (PTO). This Reexamination Proceeding was initiated (by Keneric Healthcare) in response to the '764 patent infringement case filed against Keneric Healthcare by Hydrofera, LLC, a subsidiary of Hollister, Inc., in November 2013. The rejected claim is the only claim involved in the ongoing '764 patent infringement case filed by Hydrofera, LLC. "The PTO's repeated rejection substantiates our continuing belief that the '764 patent is invalid," Keneric Healthcare’s President Dr. Jean Achterberg said. If this rejection is not overcome, the patent claim asserted against the Company in the Hydrofera litigation will be invalidated, and Keneric Healthcare will then prevail in its litigation.
