Williams Bailey Wins Fen-Phen Verdict

HOUSTON, Nov. 3 /PRNewswire-FirstCall/ -- Williams Bailey Law Firm, L.L.P., announced a $2.1 million jury verdict delivered today in Philadelphia on behalf of four women who suffered heart damage as a result of taking the diet drug “fen-phen.” The women, all residents of Utah, will apply the award to future medical treatments for the drug’s on-going side effects.

In 1997, the Food and Drug Administration announced the withdrawal of fen- phen, named for a combination of the drugs fenfluramine and an appetite suppressant called phentermine. Wyeth-Ayerst Laboratories, of Madison, New Jersey, manufactured the drugs fenfluramine and dexfenfluramine under the names Pondimin and Redux. The combination of Pondimin and Redux with phentermine resulted in serious health problems.

“This is obviously a great day for these four women and their families, but it also offers hope to the thousands of other victims who have cases pending against Wyeth,” said Steven J. Kherkher, a partner at Williams Bailey, who represented the plaintiffs. “We presented the jury with clear evidence that Wyeth marketed this drug while knowing the health hazards it caused. The jury saw Wyeth putting profits over safety. This drug never should have been brought to market in the first place.

“Williams Bailey is part of a consortium of law firms that is representing over 6,200 victims of fen-phen. Trials have been underway since July and are scheduled well into 2005 in various jurisdictions across the U.S.
